..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the 4th respondent herein to rectify the UDR mistake pertaining to 1.11 1/4 acres of agricultural land, comprised in survey No. 20/1A situated in Thekkampatty Village, Vattakkadu post, Omalur Taluk, Salem District 636 012, and to carry out name transfer of the land from the name of late, chinnathai into petitioners name and record the same in revenue records and to issue him patta for 32 1/4 cents of land within a time limit to be fixed by this Court as per his representation dated 17.01.2025. O R D E R

This Writ Petition has been filed to direct the 3rd respondent to rectify the alleged UDR mistake pertaining to the property more fully described in the prayer to the Writ Petition by rectifying the same in the revenue records and after correcting the same, issue patta in the name of the petitioner for 32 1⁄4 cents of land within a time frame to be fixed by this Court. 2.The petitioner had given a representation on 17.01.2025 for the

aforesaid purpose. Since the same was not considered by the official respondents, the petitioner has filed this Writ Petition. 3.A Counter has been filed by the official respondents as well as the private respondents. The official respondents and the private respondents have stated that since a Civil Suit is pending, pertaining to the very same dispute raised by the petitioner in this Writ Petition, only a Civil Court can adjudicate the same and the same cannot be adjudicated by the revenue authorities. 4.Admittedly, no final order is passed on the petitioner's representation dated 17.01.2025 given to the revenue authorities prior to the filing of this Writ Petition. No prejudice will be caused to the respondents if the petitioner's representation dated 17.01.

2025 seeking for correction of revenue records for the properties more fully described in the prayer to the respondents is considered on merits and in accordance with law after hearing the objections of the 5th respondent and any other third party whom the 4th respondent deems fit to inquire. This Court is not expressing any opinion on the merits of the petitioner's representation.

5.For the foregoing reasons, this Writ Petition is disposed of by directing the 3rd respondent to pass a final order on merits and in accordance with law on the petitioner's representation dated 17.01.2025 seeking for a direction to the

revenue authorities to correct the alleged UDR mistake for the properties more fully described in the prayer to this Writ Petition after hearing the objections of the 5th respondent and any other party whom the 3rd respondent deems fit to inquire within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
