The learned counsel for the applicant / plaintiff submits that in view of the part payments made by the defendants after filing of the suit, the suit claim has got reduced. Under those circumstances, he seeks permission of this Court to withdraw A. No.918 of 2024. However, he seeks liberty for the applicant / plaintiff to file a fresh application disclosing the correct amount due and payable by the respondents / defendants to the applicant / plaintiff. No prejudice would be caused to the respondents / defendants, if such a liberty is granted.

2. The learned counsel for the respondents/defendants, who has entered appearance on behalf of the respondents / defendants has also not raised any serious objection for this Court's passing such an order. Accordingly, this application is dismissed as withdrawn. However, liberty is granted to file a fresh application seeking for a direction to the respondents/ defendants to furnish security for the correct amount due and payable by the respondents / defendants to the plaintiff.
