Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to provide necessary police protection for the petitioners to take oath of office on 02.03.2022 as the Ward Members and also to cast their votes for the post of Chairman of the Komarapalayam Municipality on 04.03.2022 by considering their representation dated 26.02.2022.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This writ petition has been filed on the apprehension that the petitioners may require police protection for taking oath of office on 02.03.2022 as Ward Members and also to cast their votes on 04.03.2022 for the post of the Chairman of the Municipality concerned.

2. Learned counsel for the petitioners submitted that the oath of office has already been taken by them without any hindrance.

3. In view of the above, we find that the writ petition has been filed only on assumptions and presumptions, because the petitioners have taken oath without police protection, as otherwise, the proceedings are also covered under the CCTV cameras. Thus, no direction is required in the nature as prayed for by the petitioners looking into the facts of this case and, accordingly, the writ petition is ordered to be closed. No costs.
