S.KARTHIKEYAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehends arrest for the alleged offence under Sections 147,120(B),148, 307 r/w 34 of I.P.C in Crime No.1102 of 2020, on the file of the respondent Police, seeks anticipatory bail.
2. Totally there are 7 accused in this case and the petitioner herein is A7. The allegation is that A1 in this case said to have borrowed a sum of Rs.20,00,000/- from the defacto complainant and when the defacto complainant demanded money from A1, the petitioner along with other accused assaulted the defacto complainant with knife and caused grievous injuries to him. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offence. Hence he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the co-accused persons were detained under Goondas Act. Hence he vehemently opposed for grant of anticipatory bail, https://hcservices.ecourts.gov.in/hcservices/
7. Considering the facts of the case and the gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this Criminal Original petition is dismissed.
