ORDER

The petitioners, who were formally remanded to judicial custody for the offences punishable under Section 310(2) of BNS, in Crime No.341 of 2025, registered on the file of the respondent police from 18.10.2025, seeks bail.

The allegation against the petitioners is that the petitioners joining hands with other accused hatched conspiracy to rob money under the pretext of sale of old gold for lower price, had cheated the defacto complainant to the tune of Rs.25,00,000/-. Hence, a case has been registered and the petitioners was arrested.

4.The learned counsel for the petitioners submitted that the petitioners are ranked as A1 to A3 in this case and the co-accused have already been granted bail by this Court in Crl.OP No.1638 of 2026 dated 27.01.2026 and in Crl OP No.2859 of 2025 dated 06.02.2026 respectively. Hence, he prayed for the grant of bail to the petitioners.

5.The learned Government Advocate (Crl.side) for the respondent reiterated the prosecution case and submitted that the petitioners could not be placed on parity with other accused and the petitioners are having bad antecedents. The 1st petitioner is having seven previous cases, the 2nd petitioner is having four previous cases and the 3rd petitioner is having one previous case

of similar in nature. Hence, he opposed for the grant of bail to the petitioners. 6.I have considered the submissions made on both sides and though the co-accused have been granted bail by this Court on merits and since the 1st and 2nd petitioner are having bad antecedents, hence, I am not inclined to grant bail to the 1st and 2nd petitioners and as far as the 3rd petitioner is concerned that he is having one previous case, hence, I am inclined to grant bail to the 3rd petitioner alone subject to certain conditions:

Accordingly, the 3rd petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Coimbatore and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the 3rd petitioner shall report before the respondent police, everyday at 10:30 a.m., for a period of two weeks and thereafter, as and when required for interrogation; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the 3rd petitioner in accordance with law as if the

aforementioned conditions have been imposed and the 3rd petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
