Respondent PRAYER: Criminal Original Petition filed under Section 439 of Cr.P.C., prayed to modify the condition order dated 03.01.2024 made in Crl.M.P.No.59950 of 2023 passed by the learned V Metropolitan Magistrate, Egmore, Chennai by confirming order passed by the Principal Sessions Judge, Chennai in Crl.M.P.No.3519 of 2024 dated 05.02.2024 is so far as requiring the petitioner to execute a bond of Rs.10,000/- executing a bond for sum of Rs.10,000/- with 2 sureties and one must be blood relative and for a like sum to the satisfaction of the concerned Magistrate among them one of them should be blood relative and for like sum to satisfaction of this Court together with any two sureties along with ration card to a like sum to the satisfaction of the concern magistrate or cash surety to deposit before the concerned Magistrate till the disposal of the case. 1/4

This petition has been filed to modify the condition order dated 03.01.2024 made in Crl.M.P.No.59950 of 2023 passed by the learned V Metropolitan Magistrate, Egmore, Chennai by confirming order passed by the Principal Sessions Judge, Chennai in Crl.M.P.No.3519 of 2024 dated 05.02.2024 is so far as requiring the petitioner to execute a bond of Rs.10,000/- executing a bond for sum of Rs.10,000/- with 2 sureties and one must be blood relative and for a like sum to the satisfaction of the concerned Magistrate among them one of them should be blood relative and for like sum to satisfaction of this Court together with any two sureties along with ration card to a like sum to the satisfaction of the concern magistrate or cash surety to deposit before the concerned Magistrate till the disposal of the case 2.Heard both sides.

3.Taking all the factors into consideration, I am inclined to modify the condition imposed against the petitioner. Accordingly, this petition is ordered, to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the V Metropolitan Magistrate, Egmore, Chennai. 01.03.2024 rjr Note:
