Respondents Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the 1st respondent in his proceeding in order No.20765/C/2012, dated 18.07.2012 quash the same and consequently direct the 1st respondent to conduct proper enquiry on the second appeal dated 26.04.2012 of the petitioner and to take necessary action on the respondents 2 and 3 by imposing punishment as per relevant the provisions of the Right to Information Act 2005.

ORDER

This writ petition has been filed by the petitioner challenging the order dated 18.07.2012 passed by the first respondent under the Right to Information Act.

2. The first respondent by the impugned order dated 18.07.2012 has forwarded the application of the petitioner dated 26.04.2012 to the third respondent and directed the third respondent to furnish the information to the petitioner and report the same to the office of the first respondent on or before 12.08.2012.

3. The learned counsel for the petitioner on instructions now submits that the petitioner is satisfied if the second respondent disposes of the second appeal filed by the petitioner within a time frame to be fixed by this Court.

4. The learned Standing Counsel appearing for the first respondent as well as the learned Government Advocate appearing for the second and third respondents have no objection, if this court passes an order in terms of the request made by the learned counsel for the petitioner.

5. Recording the submissions made by the learned counsels, this Court directs the second respondent to dispose of the appeal filed by the petitioner on 26.04.2012 against the Order No.20765/C/2012 by passing final orders, within a period of eight weeks from the date of receipt of a copy of this order after giving sufficient opportunity to the petitioner to put forward his submissions. The writ petition stands disposed of. No costs.
