in Crl.O.P.No.4365 of 2025 Common Prayer : Criminal Original Petitions filed under Section 483(1)(b) of BNSS, praying to modify the condition imposed by the learned Principal District and Sessions Judge, Chengalpattu in Crl.M.P.Nos.3887 and 3888 of 2024 and 138 of 2025 in Condition No.1 that " the petitioner/accused is ordered to be released on bail on his execution of bond for Rs.10,000/- with two sureties each (out of which, one surety should be the parent of the petitioner) for a like sum to the satisfaction of the District Munsif cum Judicial Magistrate Cheyyur dated 28.01.2025 pending before this Court.

The petitioner seeks to modify the condition imposed by the learned Principal District and Sessions Judge, Chengalpattu, directing the petitioner to offer two sureties of which, one shall be a parent of the petitioner.

2. Ms. M. Divyalakshmi, the learned counsel for the petitioner, would submit that the petitioner is unable to produce one of his parents as surety as both of them are not willing and therefore submitted that he is willing to offer local sureties to the satisfaction of the learned Magistrate.

3. Heard the learned Government Advocate (Crl.Side) for the respondent.

4. Considering the fact that the petitioner is unable to comply with the condition in spite of the bail order dated 28.01.2025 and he is in custody from 29.11.2024, this Court is of the view that the condition that one of the sureties shall be the parent of the petitioner can be set aside. However, the petitioner shall execute a bond for Rs.25,000/- (Rupees Twenty-Five Thousand only) with two sureties for a like sum, who shall 3/5

be the residents of Chengalpattu.
