CORAM:

THE HONOURABLE MR. JUSTICE SATISH K. AGNIHOTRI AND THE HONOURABLE DR. JUSTICE M. VENUGOPAL Cont. P.No. 1661 of 2015 .....

A. Yuvarani ... Petitioner Vs.

Mrs. Mohana, Tahsildar, Erode Taluk, Erode, Erode District.

... Respondent Petition filed under Section 11 of the Contempt of Courts Act 1971, to punish the respondent herein for her wilful disobedience and non-compliance of the orders of this Court made in W.P. No. 19992 of 2015,dated 07.07.2015 under the provisions of Contempt of Courts Act. For petitioner :: Mr. C. Prakasam For Respondents :: Mrs. A. Srijayanthi Spl. Govt. Pleader

ORDER

(Order of the Court was made by SATISH K. AGNIHOTRI, J.)

This contempt petition is filed alleging noncompliance of the order dated 07 July 2015 rendered by this Court in W.P. No.19992 of 2015.

2.Vide the aforesaid order dated 07 July, 2015, while reserving liberty to the petitioner to take re-course to the statutory appellate forum, status quo in respect of the property in question was directed to be maintained for a period of two weeks from that day.

3. Learned counsel appearing for the petitioner submits that the appeal filed before the statutory appellate forum is still pending. After the expiry of two weeks for which status quo was ordered to be maintained, the status quo order passed by this Court has been violated.

4. The aforestated contention of the learned counsel for the petitioner does not have legs to stand. As per the order passed by this Court, status quo was directed to be maintained only for a period of two weeks and within the said period, it was for the petitioner to prefer an interim application along with the appeal and get an interim order. Having failed to get interim order within the said period, now, the petitioner cannot allege that this Court's order has been violated. Thus, in the facts situation of the

case, no contempt is made out. Accordingly, this contempt petition is dismissed.
