C.M.P.No.4466 of 2020 in S.A.No.216 of 2020 S.SOUNTHAR,J.

The petitioners/appellants herein seeks an order of interim injunction restraining the 1st respondent or his representatives from interfering with their peaceful possession and enjoyment of A Schedule property.

2. Admittedly, the suit is for declaration of title and recovery of possession and the respondents obtained a decree for their title and recovery of possession. When respondents filed a suit seeking possession through Court, the petitioners are not entitled to maintain the interim injunction application.

3. Therefore, this interim injunction application is dismissed.
