This writ petition has been filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to forbear the respondents 1 to 4 from shifting the TASMAC SHOP bearing No.7138 situated at D.No.140A Veeraganur Main Road, Thedavur Village, Gangavalli Taluk, Salem District by considering the Petitioner's representation dated 05.02.2026. ORDER
The apprehension of the petitioner in this writ petition is that the TASMAC shop in question at her premises morefully disclosed in the prayer to this writ petition may be shifted at the instance of the fifth respondent. To protect the interest of the petitioner, this writ petition has been filed to forbear the respondents 1 to 4 from shifting the TASMAC shop in question. The petitioner had given a representation dated 05.02.2026 to the official respondents for the said purpose. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
2. Mr.M.Sekar, learned standing counsel, accepts notice on behalf of the respondents 2 and 3/TASMAC, and on instructions, he would submit that the fifth respondent has already given a representation seeking for shifting the TASMAC shop in question from the petitioner's premises. He would submit
that as and when the said representation is being considered by the official respondents, the objections of the petitioner as well will be considered and only thereafter, a final decision will be taken.
3. Since no adverse orders are passed against the fifth respondent, notice to the fifth respondent in this writ petition is dispensed with.
4. This Court is not expressing any opinion on the merits of the respective contentions of the petitioner as well as the fifth respondent. No prejudice will be caused to the official respondents if the petitioner's objections with regard to shifting/closure of the TASMAC shop in question is considered on merits and in accordance with law, as and when the representation of the fifth respondent seeking to shift the TASMAC shop in question is considered. Accordingly, this writ petition is disposed of by directing the first respondent to consider the objections of the petitioner for shifting the TASMAC shop in question before passing the final, orders on merits and in accordance with law, on the fifth respondent's representation seeking for closure/shifting of the TASMAC shop in question. No Costs. W.M.P.No.5540 of 2026 is closed. 13-02-2026 RKM
