J U D G M E N T

(By.S.M.SUBRAMANIAM,J.,) The present intra Court appeal has been institute to assail the order dated 08.04.2022 passed in W.P.No.6875 of 2022. The Writ Petitioner is the appellant before this Court. 1/4

2. The Writ of Mandamus has been instituted to direct the respondents 1 to 3 to enhance and release compensation in respect of the acquired land admeasuring 2,574 sq.mtrs in S.No.107/8B (Old S.No. 107/8) in Odayandahalli Village, Denkanikottai Taluk, Krishnagiri District.

Learned counsel for the appellant would mainly contend that acquired property is unconnected with the property, which is the subject matter of a Civil Suit in O.S.No.130 of 2010 pending before the Civil Court and therefore, there is no impediment for the authorities to settle the compensation by enhancing the same.

4. Learned Special Government Pleader appearing for R1 to R3 would oppose, by stating that dispute exists between family members and the 4th respondent is none other than the brother of the appellant. Based on his objection, the Land Acquisition Officer withheld the release of compensation in favour of the appellant.

5. The Writ Court in Paragraph No.7 has directed the competent authority to refer the matter to the Civil Court in terms of Section 3H(4) of the Land Acquisition Act within a period of twelve weeks 2/4

from the date of receipt of the order. Therefore, the appellant may contest the case before the Civil Court on reference to be made by the competent authority. Granting liberty to the appellant to put forth his case before the Civil Court, the Writ Order impugned stands confirmed. Consequently, the Writ Appeal is dismissed. The Competent Authority is directed to make reference, as directed by the Writ Court forthwith without causing any undue delay. No costs.
