As the present FSI fixed at point 5 and 1 for both out side Civil area and within it respectively, a communication was sent by the Government to re-visit the bye-laws for the purpose of framing the scheme. Accordingly, the third respondent sent the https://hcservices.ecourts.gov.in/hcservices/

proposal to the first respondent in STM/Works/1/3288 dated 26.12.2016. As the same is still pending consideration, the petitioner has come forward to file the present writ petition. Heard the learned counsel appearing for the petitioner, learned counsel appearing for respondents 1 and 2 and the learned counsel appearing for the third respondent. Considering the above, a direction is issued to the first respondent to take a final decision on the proposal sent by the third respondent dated 26.12.2016 after due consultation with the Ministry of Defence, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
