PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue writ of mandamus to direct the respondents to consider the petitioner's representation dated 21.01.2015, received by them on 22.01.2015, and rectify the anamolies pointed out in the petitioner's representation and fix the pay scale of the petitioners' according to the recommendations of the Sixth Pay Commission. ORDER
It is the claim of the petitioners that they are all working as Nursing Tutor Grade-II in the Tamil Nadu Nursing Service. Though the Tamil Nadu Nursing Service Special Rules provided Nursing Tutor Grade I and Nursing Tutor Grade-II as a single category and that there is no difference in qualification prescribed to the said posts, there is a difference in the scale of pay provided to the said posts. It is the further claim of petitioners that, as per the VI Pay Commission, pay for Special Grade Nurses was fixed at Rs.5,400/-, but, the pay for Nursing Superintendent Grade II and Nursing Tutor Grade II was fixed at Rs.4700/- and therefore, due to this pay anamoly, though they made a representation on 21.01.2015, they did not receive any reply from the respondents. Hence, they filed the present writ petition seeking a direction to the respondents to dispose of the said representation.
2. Considering the limited prayer made by the petitioners, this Court directs the respondents to dispose of the representation dated 21.01.2015 made by them on merits and in accordance with law, within a period of ten weeks from the date of receipt of a copy of this order. With this direction, the writ petition stands disposed of. No Costs.
