ORDER

The learned counsel appearing for the petitioner would submit that the present writ petition has been filed by petitioner-company challenging the order of the first respondent dated 18.01.2023, in and by which, the Joint Commissioner of Labour, while allowing the condone delay petition, also had virtually allowed the main appeal filed by the second respondentemployee.

2. The learned counsel appearing for the second respondent would submit that the appeal itself has been allowed in favour of the second respondent-employee and therefore, the remedy of the petitioner is only to challenge the order passed in the main appeal. 2/4

3. In view of the above submission made by the learned counsels, nothing survives for consideration in the present writ petition, which only challenges an interlocutory application. Accordingly, the above writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
