CMP.No.3262/2022 in SA.No.766/2017 S.S.SUNDAR, J., The above miscellaneous petition is filed seeking substitution of the name of the petitioner, viz., M/s.TCI Express Limited represented by Mr.Ajay Semwal, Regional Manager, having office at 4th Floor, Gee Gee Crystal, at No.92, Dr.R.K.Salai, Mylapore, Chennai 600 004 as appellant in the place of the erstwhile appellant, viz., M/s.XPS Cargo Services.

2.It is stated by the learned counsel for the petitioner that the proposed petitioner/appellant has taken over all the charge of the erstwhile appellant, viz., M/s.TCI Express Limited by virtue of a Scheme of Arrangement approved by an order dated 14.06.2006 passed in CP.No.120/2016 connected with CA.No.118/2018 on the file of the High Court of Judicature at Andhra Pradesh.

Since the original appellant in the Second Appeal is no more in existence and the petitioner herein alone is competent to prosecute the proceedings, it is stated that the name of the petitioner should be substituted in the place of the erstwhile appellant, M/s.XPS Cargo Services.

3.Though the affidavit and petition in the above miscellaneous petition have been served on the learned counsel for the respondent, there is no representation for the respondent.

4.Hence, this petition is ordered.
