This petition is filed under Article 226 of The Constitution of India praying to issue a Writ of Mandamus to direct the respondents to consider the representation of the petitioner dated 04.10.2016 on the basis of the G.O.Ms.No.656, Labour and Employment Department dated 29.06.1978 and pass orders in accordance with law within the time frame as fixed by this Honourable Court.

By consent the writ petition is taken up for final disposal.

The petitioner would aver that he is an agriculturist and his father namely Muniyappan owned agricultural land admeasuring 0.42 acres in S.No.637-A of Punjai Thottakurichi Village, Then Karur Taluk, Karur District and those lands along with other lands were acquired by the respondent for the purpose of constructing factory for manufacturing news prints and other allied products. The petitioner further states that at the time of acquisition they promised to provide suitable employment to any one of the persons in the family from whom the lands were acquired. Learned counsel for the petitioner would submit that in the light of G.O.Ms.No.656, Labour and Employment Department

dated 29.06.1978, employment to any one of the family members who were displaced on account of acquisition of land is to be provided. The petitioner, in this regard, has also submitted a representation dated 04.10.2016 to the respondents praying for employment. Though it was received and acknowledged, it is yet to be favoured with any kind of response. Hence, he came forward to file this writ petition.

3. This Court has considered the submission of the learned counsel for the petitioner and also perused the materials available on record.

An award in this regard was passed as early as on 16.04.1982 and though the Under Secretary to Government, Industries Deparment vide letter No.56577/MIG Government II 82 on 20.09.1980 has directed the 1st respondent to consider the representation submitted by the President, Association of Land Owners whose lands are to be acquired for the Pugalur Newsprint Project dated 06.08.1982 in the light of the above said G.O.

5. The grievance expressed by the petitioner is that despite lapse of very many years, the representation submitted on behalf of the persons who have been displaced on account of the land acquisition are yet to be considered. Therefore prays for appropriate relief.

This Court, taking into consideration the above facts and circumstances, without going into the merits of the claim projected by the petitioner either in the representation or in the writ petition, directs the 1st and 2nd respondents to consider and dispose of the petitioner's representation dated 04.10.2016 on merits and in accordance with law and pass orders within a period of ten weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner. The writ petition is disposed of accordingly. No costs.
