ORDER
This Criminal Miscellaneous Petition has been filed by the petitioner/de-facto complainant seeking to cancel the anticipatory bail granted to the bail petitioners 1, 6 & 7/Respondents 1 to 3 herein, by this Court made in Crl.O.P.No. 4424 of 2025, dated 07.01.2026. 2.Mr.P.Sathyanathan, learned Counsel for the petitioner/de-facto complainant submitted that the bail petitioners have surrendered before the concerned Metrpolitan Magistrate Court after 15 days of the order passed by this Court which is in violation of the conditions imposed by this Court. However, the learned Metropolitan Magistrate Court accepted the sureties which is not proper. He further submitted that, as per the copy of the order, uploaded on the website, the bail petitioners ought to have surrendered before the concerned Metropolitan Magistrate Court on or before 27.01.2026. However, they have surrendered only on 03.02.2026. Thereby the bail petitioners have violated the conditions. Hence, he prayed to cancel 2/5
the anticipatory bail already granted to the bail petitioners. 3.Learned Counsel for the bail petitioners submitted that this Court passed an order in Crl.O.P.No.4424 of 2025, dated 07.01.2026 wherein, the relevant Paragraph No.7 which reads is as follows:- 7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearances, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Metropolitan Magistrate for Exclusive Trial of CCB Cases (relating to cheating cases in Chennai), and CBCID Metro Cases, Egmore, Chennai, on condition that the petitioners shall execute a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions:
4.The bail petitioners have produced Intimation Memos issued by the learned Metropolitan Magistrate, Egmore, Chennai-8, dated 13.02.2026, informing that as per the order of this Court dated 07.01.2026, the bail petitioners have executed a bond for Rs.20,000/- with two sureties each for a like sum to the satisfaction of the said court. The learned Metropolitan Magistrate has already accepted the sureties, though it is alleged there is violation of the order in this regard. Further, the allegation made in this petition is that delayed extension of sureties. Since the learned Metropolitan 3/5
Magistrate has accepted the sureties, this Court is not inclined to sit on appeal against the acceptance of sureties. Hence, the present petition filed by the de-facto complainant seeking cancellation of anticipatory bail is dismissed.
5.Accordingly, this Criminal Miscellaneous Petition shall stands dismissed.
