Respondent Prayer: Petition filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus calling for the records relating to the impugned order of the respondent in the proceeding in RC. No.COP/Pen.1/04/5145/2014 dated 18.03.2016 and quash the same and directing the respondent herein to disburse his DCRG Rs.5,65,950/- along with the interest as per G.O. No.173 Finance (Pension) Department dated 01.04.2004 and grant him all consequential benefits.

O R D E R

This writ petition has been filed, without any basis whatsoever, challenging the show cause notice dated 18.03.2016 in Proceeding RC. No.COP/Pen.1/04/5145/2014 in which the petitioner has been directed to pay a sum of Rs.43,136/- and interest at the rate applicable for the over drawn salary amount of Rs.5,94,866/-.

2.Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the respondent.

3.Since the said impugned show cause notice has given 15 days time to submit the explanation of the petitioner, it appears that the petitioner after giving his explanation, before https://hcservices.ecourts.gov.in/hcservices/

passing any order by the respondent, has come to this Court challenging the said show cause notice, which is not legally permissible. Therefore, this Court is not inclined to entertain this petition. Accordingly, the Writ Petition fails and the same is dismissed. No costs. Consequently, connected W.M.Ps are also dismissed.
