O.P.No.707 of 2011 R.SUBRAMANIAN.J., The petitioners seek issuance of Letters of Administration with a copy of the Will annexed for the Will of late Mrs.J.Komala Wife of Mr.B.Jaganathan dated 20.01.2003.
2. The petitioners 1 to 3 are the son and daughters of the deceased Mrs.J.Komala. The 4th petitioner is the mother of the deceased. The petitioners 5 to 9 are the grand-children of the deceased as well as legatees.
3. The 1st petitioner has been examined as PW1. He has produced the death certificate of the deceased Mrs.J.Komala as Ex.P1, the original Will dated 20.01.2003 as Ex.P2, the legal heirship certificate as Ex.P3. The death certificate of the husband of the testatrix Mr.B.Jaganathan has been marked as Ex.P4. The petitioners have also examined one Mr.Rajendran, son of Mr.S.P.Sundaramoorthy as PW2. He has spoken about the execution of the Will by the Testatrix and its attestation by himself and one Mr.J.Jayakumar as second attesting witness. The said Mr.J.Jayakumar has been examined as PW3. Despite service, the respondents have not chosen to appear.
4. In view of the above evidence, I find that the petitioners have proved execution of the Will by the deceased Mrs.J.Komala. Hence, this Original http://www.judis.nic.in
R.SUBRAMANIAN.J., dsa Petition is allowed granting Letters of Administration with the Will annexed in favour of the petitioners. The petitioners shall execute a security bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) in favour of the Assistant Registrar (O.S.II), High Court, Madras.
