This Writ Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, to direct the respondents to consider the representation dated 28.10.2018 and consequently direct the respondents to select the petitioners to the posts of unfilled 120 vacancies for the posts of Physical Educational Teachers (Special Teacher) of either from reserved category of Tamil Medium Students or from general category of Tamil Medium Students or from general category.

O R D E R

Admittedly, the writ petitioners are not selected candidates for appointment to the post of Physical Education Teachers (Special Teacher). However, the learned counsel for the writ petitioners state that they stand next below the selection list and therefore, if at all, any wait list is prepared or released, the name of the writ petitioners shall be considered.

2. This Court is of an opinion that the authorities competent are bound to follow the selection list scrupulously. Wait list/reserved list are to be prepared and released, in accordance with the rules in force. Mere sending of a representation would not confer any right on the writ petitioners to claim selection or appointment. However, if at all, the case of the writ petitioners falls within the parameters of the wait list /reserve list, the case of the writ petitioners also shall be considered along with all other similarly placed persons and strictly in accordance with the rules in force.

3. With these observations, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
