ORDER

This petition has been filed to register the complaint dated 30.04.2016 before the second respondent and the complaint dated 05.05.2016 before the first respondent and investigate the same in accordance with law.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. https://hcservices.ecourts.gov.in/hcservices/

3. It is submitted by the learned Additional Public Prosecutor that on the complaint dated 30.04.2016 which was received by the police on 01.05.2016, petition enquiry was conducted in C.S.R. No.103 of 2016 and the same was closed. Again, the petitioner has lodged a fresh complaint dated 05.05.2016, based on which, petition enquiry is pending in C.S.R. No.106 of 2016.

4. Recording the submission of the learned Additional Public Prosecutor, the second respondent is directed to conduct enquiry in C.S.R. No.106 of 2016 and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner.

This Criminal Original Petition is disposed of with the above direction.
