4. Miss. Sudha ...Defendants PRAYER: Plaint filed under Order VII Rule 1 of the C.P.C. read with Order II Rule 1 of the Original Side Rules, praying for;

(i) directing the defendants herein to execute the requisite deed of conveyance viz. Sale deed at the cost of the plaintiff; by all the defendants in respect of the plaint schedule properties conveying it absolutely to the plaintiff herein on receipt of the balance of sale consideration of Rs.1 Crore; in any event if they fail to execute the sale deed directing the Registrar of the High Court to execute similar Instrument of Conveyance; conveying suit properties to the plaintiff on behalf of the defendant on any such condition may be imposed.

(ii) In the alternative directing the defendants to pay a sum of Rs.18,00,000/- to the plaintiff with interest at the rate of 18% p.a. from the date of decree till the date of realisation; together with interest that may be deemed just and fit by this Court. (iii) directing the defendants to pay the costs of the suit. For Plaintiff : Mr.V.S.Mannarsamy For Defendants : Mr.B.Divakaran for defendants 1,2 and 4 No Appearance for 3rd defendant.

J U D G M E N T

The parties have arrived at a settlement before the learned Mediator, Tamil Nadu Mediation and Conciliation Centre, High Court, Madras and a Joint Memo of Compromise dated 12.10.2018 has been duly executed by the plaintiff and the defendants 1 & 2 as well as their respective counsel.

2. Learned counsel appearing for the plaintiff confirms that the dispute in suit has been resolved and the defendants have settled the entire liability to the plaintiff. Accordingly, all defendants are discharged from any further liability of payment whatsoever.

3. Recording the same and placing the joint memo of compromise which shall form part and parcel of the suit on record on file, the suit is decreed in terms of the Joint Memo of Compromise.
