Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus to direct respondents 1 to 3 to take necessary steps and to retrieve the public road comprised in Survey No.408/6, Acharapakkam Village, Madurantagam Taluk, from encroachment within a stipulated time.

ORDER

(Order of the Court was made by M.Sundar,J.) The writ petition has been filed with a prayer to retrieve a public road from alleged encroachment.

2. Respondents 1 to 3 before us are official respondents and Mr.M.K.Subramanian, Government Pleader accepts notice on their behalf.

3. Respondents 4 to 6 are private respondents and it is alleged by the writ petitioner that they have encroached upon the public road.

4. We direct the second respondent/Tahsildar to cause a local inspection to be made qua the land comprised in Survey No.408/6, Acharapakkam Village, Madurantagam Taluk, within a fortnight and if any encroachment is found, the official respondents shall take action in accordance with law after putting on notice all concerned, particularly private respondents 4 to 6 before us, and conclude the proceedings within two months.
