The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 406 and 420 of IPC in Crime No.5 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that petitioner has cheated a sum of Rs.37,00,000/- from the defacto complainant. Hence the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner was worked as Second Grade Police Constable in Police Department. He borrowed a sum of Rs.37,00,000/- from the Defacto complainant out of which, he repaid Rs.15,00,000/- to the Defacto complainant. He further submitted that the petitioner was suspended from the service. Hence, he prayed to grant anticipatory bail for the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner was not in service. He further submitted that the petitioner was collected Rs.73,00,000/- from various persons. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Heard, learned counsel for the petitioner and also learned Government Advocate (Crl.Side) appearing on behalf of the respondent.

6. On perusal of the records, it is seen that the petitioner was collected amount from various persons and cheated them while he was in service. It is a clear violation of the duty casted upon him. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 27.02.2023 dk
