Respondents Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents 1 to 4 to consider the representation dated 28.07.2014 and cancel the patta issued in the name of 5th respondent and issue the patta in the name of the petitioner for the agricultural lands comprised in Survey No.176/5A, 176/5C, Vadakkunanthal West Village, Chinnasalem Taluk, Villupuram District.

By consent, the writ petition is take up for final disposal.

2. The petitioner claims that he is the owner of the agricultural land measuring about 48 cents comprised in Survey Nos.176/5A and 176/5C, Vadakkunanthal West Village, Chinnasalem Taluk, Villupuram https://hcservices.ecourts.gov.in/hcservices/

District and he it was purchased by him by means of a oral sale in the year 1970. It is further stated by the petitioner that without putting him on notice, the name of the 5th respondent has been entered in the UDR Patta and in this regard, he submitted a representation dated 05.07.2013 as well as a further representation dated 28.07.2014 and since he has not been favoured with any response, he has come forward with this writ petition.

3. Heard the submissions of Mr.S.Sarvanan, learned counsel appearing for the petitioner and Mr.Durai Solaimala, learned Additional Government Pleader accepts notice for the respondents 1 to 4.

4. This Court without going into the merits of the representation dated 28.07.2014 submitted by the petitioner, directs the second respondent to consider and dispose of the representation of the petitioner dated 28.07.2014, on merits and in accordance with law, after putting the fifth respondent on notice and pass orders as expeditiously as possible and not later than six weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner as well as the 5th respondent. The writ petition is disposed of accordingly. No costs.
