Respondents Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the second respondent to sub divide and issue separate patta in the name of petitioners namely K.M.Ravichandran and M.R.Deivanai after surveying or de-marking the property in respect of S.No.75/2, Veerakkal Puthur Village, Mettur Taluk, Salem District within stipulated time.

2. The first petitioner claims that he purchased a property in S.No.75/2 measuring an extent of 55 cents at Veerakkal Pudhur Village, Mettur Taluk, Salem District vide Doc.No.1138 of 2008 dated 11.07.2008 and his wife, the second petitioner herein, has purchased a property in S.No.75/2 measuring an extent of 55 cents at Veerakkal Pudhur Village, Mettur Taluk, Salem District vide Doc.No.1139 of 2008 dated 11.07.2008 and they are in possession and enjoyment of the same. They submitted an application dated 17.02.2014 to the second respondent for issuance of separate patta in their names and since they have not been favoured with any response, they have come forward with this writ petition.

3. Heard the submissions of Mr.M.R.Jothimanian, learned counsel appearing for the petitioners and Mr.RAS.Senthilvel, learned Additional Government Pleader accepts notice for the respondents.

4. This Court without going into the merits of the representation dated 17.02.2014 submitted by the petitioners, directs the second respondent to consider and dispose of the representation of the petitioners dated 17.02.2014, on merits and in accordance with law, after putting the concerned person on notice and pass orders as expeditiously as possible and not later than six weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioners as well as the concerned person.
