ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 132, 275, 123 of BNS Act and Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) and Section 24(1) of the Cigarettes and other Tobacco Products Act, 2003 in Crime No.208 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused alleged to have involved in illegal transportation of banned tobacco products.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police state that the petitioner had illegal transportation of 390 kg of tobacco products worth Rs.6,00,000/-. He further submits that the petitioner is a native of Andhra Pradesh, on chasing he dashed into another Government vehicle and left the vehicle and flew away and that damage cost Rs.50,000/-. He further would submits that there is one previous case of similar in nature as against the petitioner and hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

6. In view of the serious allegation against the petitioner, this Court is of the view that it is not desirable to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed.s Criminal Original petition is dismissed.
