ORDER
The petitioner/A4 apprehends arrest for the alleged offence under Sections 303(2), 326 of BNS Act in Crime No.4 of 2026, on the file of the respondent police seek anticipatory bail.
2. The case of the prosecution is that the petitioner, along with other accused illegally quarried 2 units of river sand from Palar, which is an already dying river, by using a tractor and other vehicles. Hence the case.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed the offences alleged by the defacto complainant. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) submitted that the 2 units of river sand has been illegally extracted from the river. Hence, he opposed to grant anticipatory bail to the petitioner.
5 Considering the nature of offence committed by the petitioner, and
taking note of the fact that the petitioner is not only involved in quarrying river sand but also in damaging the ecology and the river bed itself, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
