Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue writ of certiorarified mandamus calling for the records calling for the records relating to the Award in I.D.No.39 of 2009 dated 28.04.2015 on the file of the Addl. Labour Court, Vellore, and quash the same and consequently confirm the order of dismissal of service of the 2nd respondent. 1/4

For R1 : Court For R2 : M/s.R.Rajaram C O M M O N O R D E R Ms.P.T.Ramadevi, learned counsel for the petitioners would submit that as per the order of National Company Law Tribunal Division-I, Chennai in IBA/976/2019 dated 29.07.2021, the writ petitioners' institution have been ordered to be wound up.

2. I adjourned the matter to find out if the IRP is interested to continue with the proceeding. Learned counsel for the petitioners would submit that she informed the Interim Resolution Professional (IRP). But the IRP responded saying that he himself has been changed. As on today, the company cannot be represented by its erstwhile directors. The Interim Resolution Professional has not appeared and taken any steps to substitute himself in place of the erstwhile company.

3. Therefore, these writ petitions stand dismissed for default. Connected miscellaneous petitions are closed. No costs. 22.06.2023 nst Index : Yes/No 2/4
