PRAYER : Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus to call for the records dated 09.02.2024 in En.21/Vu.Ve.Aa/SAL/2024 and quash the same consequently direct the respondents to give permission for 1/6

conducting the meeting by the petitioner at Sheikh Dhawood Street, Ice House, Royapettah, Chennai - 14 on 24.02.2024 Saturday evening 6'O clock.

ORDER

This writ petition has been filed for a direction to the respondent police to grant permission to conduct the meeting organized by the petitioner at Sheikh Dhawood Street, Ice House, Royapettah, Chennai.

2. Heard Mr.R.Jaikumar, learned counsel for petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor appearing for respondents.

3. When the matter came up for hearing on 26.02.2024, this Court passed the following order:

"When the matter came up for hearing, learned Additional Public Prosecutor, on instructions, submitted that the meeting will be permitted to be conducted in an alternate place in CNK Road, which comes within the jurisdiction of D1-Triplicane Police 2/6

Station.

2. Learned counsel for petitioner submitted that the petitioner is also agreeable to conduct the meeting in the said venue.

3. Before passing further orders, this Court wants to ascertain as to whether this association is registered, who are the office bearers of this association and who are the members of this association. These particulars are necessary in order to enable the police to understand as to who is conducting this meeting.

4. Learned counsel for petitioner submitted that an affidavit will be filed in this regard before this Court. Post this case under the same caption on 29.02.2024."

4. Pursuant to above order, the learned counsel for petitioner filed affidavit and additional typed set of papers and this Court directed learned Additional Public Prosecutor to verify the antecedents of the petitioner and other office bearers.

5. When the matter was taken up for hearing today, learned Additional Public Prosecutor submitted that there are no bad antecedents both for the petitioner and other office bearers.

6. In the light of the above clarification, there shall be a direction 3/6

to the petitioner to submit a fresh representation before the third respondent by informing the date and time of the meeting at Sheikh Dhawood Street, Ice House, Royapettah, Chennai. The petitioner shall also file necessary undertaking affidavit before the third respondent undertaking that the meeting will be conducted in a peaceful manner without giving raise to any law and order problem. On receipt of the same, the third respondent shall grant permission by imposing reasonable conditions.

This Writ Petition is disposed of with the above direction. No costs.
