ORDER

This application has been filed to grant leave to the applicant/plaintiff to institute the above suit before this Court in respect of Schedule 'B' of the suit property, which is situated outside the jurisdiction of this Court.

2. According to the applicant, he is the plaintiff in the main suit for partition and separate possession as against the defendants. The 'A' schedule property is situated within the jurisdiction of this Court and 'B' schedule property is situated outside the jurisdiction of this Court, therefore, the applicant has come up with the present application.

3. Heard the learned counsel for the applicant and perused the entire documents placed on record.

4. Considering the above said reasons stated in the affidavit filed in support of the application and taking note of the fact that 'A' schedule property is situated within the jurisdiction of this Court and substantial part of cause of action arose within the jurisdiction of this Court and the fact that the 'B' schedule property is situated outside jurisdiction of this Court, therefore, it is appropriate to allow the present application.

5.Accordingly, the present application is allowed. Registry is directed to number the suit, if it is otherwise in order. 26-02-2026 DN
