A.No.845 of 2021:
Application praying that this Hon'ble Court be pleased to direct the 2nd Respondent to refund the fixed deposit in F.D.No.34542462604 along with accrued interest to the Applicant.
A.No.846 of 2021:
Application praying that this Hon'ble Court be pleased to pass an order directing the 1st Respondent to return the Original Bank Guarantee to the Applicant along with a no Claim Letter.
These Applications are coming on this day before this court for hearing the court made the following order:
Earlier, this Court has passed an order on 31.03.2021, wherein Mr.Y.T.Arvind Gosh, who entered appearance on behalf of the 1st respondent undertook to handover the original bank guarantee to the 2nd respondent's counsel on or before 07.04.2021.
2. When the application is taken up today, on behalf of the respondent Bank, a memo of compliance dated 09.04.2021, has been filed. The contents of the memo are hereunder recorded.
"It is respectfully submitted that this Hon'ble Court vide order dated 31.03.2021 was pleased to direct the 1st respondent to
handover the Original Bank Guarantee to the 2nd Respondent Counsel on or before 07.04.2021. It is submitted that due to the State Legislative Assembly Elections, the Original Bank guarantee was handed over to the 2nd Respondent Counsel on 08.04.2021. This proof of the same is enclosed herewith. Therefore, it is humbly prayed that this Hon'ble Court may be pleased to accept the memo of compliance and thus render justice."
3. In view of the same, no further orders are necessary to be passed in these applications and hence, the same stand closed. Sd/.V.P.N.J.
