The petitioner/A3 who apprehends arrest at the hands of the respondent police for the offences under Sections 409 and 420 IPC of IPC, in Crime No.307 of 2023, seeks anticipatory bail.
2. An inspection team of Aavin had conducted a search in the house of the petitioner had seized 140 Kgs of Aavin butter and 175 Kgs of milk powder along with empty Aavin bags and bottles. It had been very specifically stated that the petitioner has no cows and the only inference is that the petitioner was adulterating milk with water and selling it. It had been stated that the defacto complainant had suffered loss of more than Rs.2,00,000/-.
3. A counter affidavit had been filed, wherein, it had been stated that the Vigilance Department of Aavin had seized the aforementioned products. It had also been stated that the petitioner has been engaging in selling the adulterated milk for the past four years. 1/3
4. An earlier application seeking anticipatory bail was dismissed by an order, dated 23.01.2024 in Crl.O.P.No.234 of 2024. A counter has been filed stating that even though the respondent had formed a special team and searched in various places, they could not secure the petitioner herein.
5. It is also stated that the investigation is at preliminary stage and the petitioner is required for interrogation. In view of those facts, I am not inclined to grant anticipatory bail to the petitioner herein.
