Ms.S.Mekhala Standing Counsel Order This Writ Petition has been filed seeking issuance of a writ of mandamus directing the respondents 1 to 5 to consider and pass appropriate orders on the representations of the Petitioner-Company dated 06.10.2025 and 06.11.2025.
2. The petitioner company is a registered Class I contractor under the Public Works Department and was issued Contractor Registration No. 21603 dated 03.11.2021 by the Tamil Nadu Water Supply and Drainage Board. In the course of its business, the petitioner was awarded the work of design and construction of a Sewage Treatment Plant with a capacity of 16.71 MLD at Ambur. The project was inaugurated on 24.02.2024, and the trial run had commenced on 01.03.2024, as certified by the 5th respondent. Upon successful completion of the trial run, the 5th respondent, by communication dated 28.11.2024, had confirmed the commencement of paid maintenance for a period of 10 years from 28.11.2024. However, the petitioner was not compensated towards price escalation and accordingly, raised five bills claiming a total sum of Rs.84,12,268.20.
The petitioner also submitted representations dated 06.10.2025 and 06.11.2025 seeking payment of the said amount and objecting to the deduction of electricity charges incurred during the trial run period amounting to Rs.72,28,990/-. The said representations have not been considered or replied to by the respondents. Hence, the petitioner is before this Court.
3. Heard both sides and perused the materials available on record.
4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents to consider and pass orders on the petitioner's representation dated 06.10.2025 and 06.11.2025 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of. No costs.
