Crl.O.P.No.5209 of 2022 in Crl.A.SR.No.9416 of 2022 Crl.O.P.No.5209 of 2022 in Crl.A.SR.No.9416 of 2022 R.PONGIAPPAN, J.

This petition has been filed to grant leave to the petitioner herein to prefer an appeal against the judgment dated 01.02.2021 made in C.C.No.86 of 2017 on the file of the learned Judicial Magistrate, Fast Track Court at Magisterial Level, Tiruppur.

2.

The learned counsel for the petitioner would submit that after differentiating the name of the petitioner as Nagaraj and Nagarajan, the trial Court dismissed the complaint filed by the petitioner. 3.

Now, on considering the said submission with the relevant records, it is not in dispute that the alleged cheque has been issued from the account maintained by the respondent / accused. 4.

Hence, in view of the above, the petitioner shown a prima facie case for filing an appeal. Accordingly, leave granted. 10.03.2022 Note: Registry is directed to number the appeal, if it is otherwise in order.
