2. The ground on which COD i.e., COD in representation has been sought is articulated in paragraph 5 of the affidavit filed in support of captioned application and the reason inter alia is communication regarding return of papers by Registry sent by the Advocate Clerk was not delivered to the party.

3. This Court, having heard learned counsel for petitioners, having perused the affidavit filed in support of captioned CMP and being satisfied that the ground is tenable, comes to the conclusion that COD prayer deserves to be acceded to.
