Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus, directing the respondents herein to pay fixed Single Rate Overtime Allowance and fixed Double Rate Overtime Allowance to the petitioner continuously from December 2014.

The petitioner is working as Master Grade II in Marine Department in Chennai Port Trust. The Port Trust has been paying fixed Single Rate Overtime Allowance and fixed Double Rate Overtime Allowance. However, with effect from December 2014, the respondents had discontinued the payment of fixed Overtime Allowance. The petitioner submitted a representation on 02.01.2015 requesting to restore fixed Single Rate Overtime Allowance and fixed Double Rate Overtime Allowance, which was stopped without notice. The present request is to direct the first respondent to consider the representation and restore the payment of fixed Single Rate Overtime Allowance and fixed Double Rate Overtime Allowance.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel on behalf of Chennai Port Trust. https://hcservices.ecourts.gov.in/hcservices/

3. The first respondent is directed to consider and dispose of the representation submitted by the petitioner on 02.01.2015 on merits and as per law. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

The writ petition is disposed of with the above direction. No costs.
