This application is filed under Section 9 of the Arbitration and Conciliation Act seeking a direction to the respondents to furnish security to the tune Rs.9,22,868/-, failing which, to order attachment of the property, mentioned in the Schedule to the Judge's Summon.

2. Heard the learned counsel for the applicant.

3. This Court, vide order dated 21.07.2015, directed the respondents to furnish security to the extent of the claim made by the applicant, within a period of two weeks therefrom.

4. Notice was ordered to the respondents, in this application, on 21.07.2015. However, the notices sent to the respondents have been returned as 'Refused' and since it amounts to service, the learned Master has directed the matter to be posted before this Court, by an order dated 05.11.2015.

5. Despite notice, along with summons, having been served on the respondents, and their names are also printed in the cause list, the respondents have not chosen to appear before this Court either in person or through a counsel. Hence, there shall be an order of attachment of the immovable property mentioned in the schedule to the Judges Summons. The application is ordered accordingly.
