Prayer: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order No. Se. Mu. Ka. No. 293 / 2021 / A5 dated 2.2.2021 passed by the 1st Respondent, quash the same and consequently direct the 1st respondent to restore and retain the petitioner as Road Inspector Grade - I as per the order of promotion dated 30.11.2015 with all consequential benefits. ORDER

When the writ petition is taken up for hearing, learned counsel for the petitioner submits that despite her best efforts, she is not been able to contact the petitioner.

2. Learned Special Government Pleader appearing on behalf of the respondents on the other hand has placed before this Court, a copy of the letter dated 16.07.2024 addressed by the petitioner to the Divisional Engineer (H), Construction and Maintenance, Tiruvarur intending to withdraw the present writ petition and submits that the Divisional Engineer (H), Construction and Maintenance, Tiruvarur issued proceedings dated 31.01.2026 to the Government Pleader, High Court of Madras, informing that the petitioner has instructed his counsel to withdraw the writ petition in W.P.No.5441 of 2021.

3. Learned Special Government Pleader further submits that since the petitioner himself addressed the aforesaid letter to the Divisional Engineer, that he intends to withdraw the writ petition pending consideration before this Court and also in view of the subsequent development i.e., promotion of the petitioner to the post of Junior Draughting Officer from the post of Road Inspector, the grievance of the petitioner in the present writ petition would not survive for consideration.

4. Having regard to the aforesaid submission, since the petitioner has instructed his counsel to withdraw the petition and also taking note of the fact that the petitioner himself by letter dated 16.07.2024 sought to withdraw the writ petition, this Court is of the view that the petitioner is not interested to pursue the writ petition on account of the subsequent development.

5. In view of the above, this writ petition is closed as infructuous. No costs. Consequently connected miscellaneous petition is closed. 02-02-2026 Index: Yes/No Speaking/Non-speaking order MSV
