Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 15.11.2018 and further direct the 2nd respondent to grant separate patta in the properties situated in S.No.167 to an extent of 3.57 acres and to include the petitioner's name as Joint Pattadhar in Patta No.570 to the properties situated in S.No.177/7 to an extent of 5 cents, S.No.177/8 to an extent of 6 cents and S.No.177/9 to an extent of 19 cents, in Vedal Village Account, Arakkonam Taluk, Vellore District.

Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

The petitioner seeks for a Mandamus directing the 2nd respondent to consider his representation dated 15.11.2018, wherein and whereby, he sought for granting separate patta for the properties situated in S.No.167 to an extent of 3.57 acres and to include his name in Patta No.570, as Joint Pattadhar to the properties situated in S.No.177/7 to an extent of 5 cents, S.No.177/8 to an extent of 6 cents and S.No.177/9 to an extent of 19 cents, in Vedal Village Account, Arakkonam Taluk, Vellore District.

4. Now, the grievance of the petitioner before this Court is that the said representation has not been considered by the respondents so far.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the second respondent to consider the representation dated 15.11.2018 and pass orders on the same on merits and in accordance with law, after hearing all the parties concerned. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
