Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to transfer the petitioner name from Contributory Pension Scheme to Old Pension Scheme prevailed prior to implementation of contributory pension scheme based on the representation of the petitioner, dated 12.01.2026. ORDER
The present Writ Petition has been filed seeking a direction to the respondents to transfer the petitioner name from Contributory Pension Scheme to Old Pension Scheme prevailed prior to implementation of contributory pension scheme based on the representation of the petitioner, dated 12.01.2026.
2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader takes notice on behalf of the 1st and 2nd respondent. Mr.S.Venkatesh, learned counsel takes notice on behalf of the 3rd respondent. Ms.G.Vardhini Karthik, learned counsel takes notice on behalf of the 4th respondent.
3. The petitioner was appointed as Lab Technician on consolidated pay in the 3rd respondent university by way of direct recruitment in the year 2002. Thereafter, his services were regularized in the year 2004. It is the case of the petitioner that, even prior to the issuance of G.O.No.259, Government of Tamil Nadu dated 06.08.2003 whereby the Contributory Pension Scheme was introduced by cancelling the Old Pension Scheme with retrospective effect from 01.04.2003, he had entered into service and therefore, he is entitled to the benefit of Old Pension Scheme. In order to avail the said benefit, the petitioner submitted a representation dated 12.01.2026 to the respondents seeking to consider him under Old Pension Scheme. However, till date, the said representation has not been considered Hence, the present Writ Petition.
4. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents to consider the petitioner's representation dated 12.01.2026 and to pass appropriate orders on the same within the time that may be stipulated by this Court.
5. On the above contention, this Court, heard the learned Counsel appearing for the respondents.

In view of the limited relief sought for in this Writ Petition, this Court without expressing any opinion on the merits of the case, directs the 3rd respondent to consider the petitioner's representation dated 12.01.2026 and pass appropriate orders on the same on merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
