Respondents PRAYER: Petitions filed under Article 226 of the Constitution of India, for issuance of a writ of mandamus directing the respondents to issue sale deed to the petitioner by collecting only the enhanced compensation fixed by the Hon'ble Apex Court to the original land owners from whom the land was acquired to the petitioner allotted plot in No.M1086 (MIG), Muthampalayam-II, Erode District, within a time frame that may be fixed by this Court.

ORDER

This writ petition has been filed for a mandamus to direct the respondent to execute a sale deed in favour of the petitioner by collecting the enhanced compensation fixed by the Hon'ble Supreme Court.

2. The learned standing counsel for the respondents 2

and 3 has produced a receipt dated 29.10.2019 issued by the respondent Tamil Nadu Housing Board in favour of the petitioner for a sum of Rs.11,80,000/- towards full and final settlement of the claim made by the Tamil Nadu Housing Board. A confirmation deed dated 13.02.2020 executed by the petitioner has also been filed. The learned standing counsel for the respondents 2 and 3 submits that the respondent is willing to execute the sale deed in favour of the petitioner and therefore, nothing survives for adjudication in this writ petition.

3. Recording the submission made by the learned standing counsel for the respondents 2 and 3 as well as the confirmation deed dated 13.02.2020, the respondents 2 and 3 is directed to execute the sale deed in favour of the petitioner within a period of four weeks from the date of receipt of a copy of this order.

4. With the aforesaid direction, this writ petition is closed. No costs.
