The petitioner who was arrested and remanded to judicial custody on 30.12.2023 for the offences under Sections 20(b)(ii)(A) r/w 8(c) of NDPS Act 1985 and 77 of Juvenile Justice Act r/w 34 of IPC in Crime No.113 of 2023, on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that the petitioner was found in illegal possession of 21 packets of ganja and another accused was found in illegal possession of 16 packets of ganja.
3The learned counsel for the petitioner stated that the quantity of contraband is intermediate quantity.
4.The learned Government Advocate (crl.side) stated that there are 40 previous cases against the petitioner, out of which, several cases have been registered under 302 and 307 IPC and specifically under NDPS Act. 5.At this stage, the learned counsel the petitioner stated that all those cases have been registered for statistical purpose. 6.Taking into consideration the antecedents of the petitioner, I am not inclined to grant bail to the petitioner. https://www.mhc.tn.gov.in/judis 1/2
