C.M.P.No.3837 of 2021 in The petition has been filed to condone the delay of 2076 days in filing the petition to set aside the abatement caused due to the death of the sole respondent.

2.Though the petitioner has satisfactorily explained the reasons for the delay in the affidavit filed in support of the petition, since the delay is on the higher side, we are of the view that the same can be condoned on payment of costs. Accordingly, the delay of 2076 days in filing the petition is condoned on condition the petitioner paying a sum of Rs.5,000/- (Rupees five thousand only) to the learned counsel for the proposed respondents within a period of two weeks from the date of receipt of a copy of this order, failing which, it is made clear that the petition shall stand dismissed automatically without any further reference to this Court.

Hence, the petition is ordered.

Post the appeal on 01.07.2022.
