Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the second and third respondents to survey and demarcate the petitioner's agricultural land situated in Survey No.252/2, Patta No.111 situated in Kadachanallur Post, Thiruchengode Taluk, Namakkal District within a time frame to be stipulated by this Hon'ble Court.

ORDER

The grievance expressed by the petitioner is that the agricultural land admeasuring an extent of 4.77 acres (patta No.111) comprised in S.No.252/2 situated at Kadachanallur village, Thiruchengode taluk, Namakkal District has been encroached by the western side adjacent land owners and therefore, she approached the second and third respondents to survey and demarcate her land and inspite of receipt and acknowledgment of the application/representation dt. 11.4.2016, no orders have been passed and therefore, she came forward to file the present writ petition.

2. The writ petition was taken up for admission on 09.03.2017. On that date, Mr.R.S.Selvam, learned Government Advocate accepted notice on behalf of the respondents and sought time to get instructions and therefore, the writ petition is listed today.

3. The Tahsildar, Kumarapalayam sent a communication dated 12.03.2017 in Roc.1356/2017/A5 to the learned Government Advocate informing that no portion of the land of the petitioner got merged with the land situated in the western side and seek time to communicate the said decision to the petitioner.

4. In the light of the stand taken and without going into the merits of the case, directs the Tahsildar, Kumarapalayam to communicate the result of the application/representation dated 11.4.2016 to the petitioner within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition, accordingly, stands disposed of. No costs.
