Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd Respondent herein restore the petitioner father name in patta number bearing No.1406 and name transfer patta in favour of the petitioner belongs to petitioner property, bearing old survey 170/12 and New T.S.Nos.19 totally admeasure 2000 Sq ft., which is situated in Ward No.E, Block No.48 Salem West Taluk, Salem District belongs to the petitioner. ORDER

This Writ Petition is filed for a writ of Mandamus, directing the 2nd Respondent herein restore the petitioner father name in patta number bearing No.1406 and name transfer patta in favour of the petitioner belongs to petitioner property, bearing old survey 170/12 and New T.S.Nos.19 totally admeasure 2000 Sq ft., which is situated in Ward No.E, Block No.48 Salem West Taluk, Salem District belongs to the petitioner. 2.Mr.E.Balamurugan, learned Special Government Pleader entered appearance for the respondents and submitted that the petitioner is essentially seeking cancellation of patta issued to the third parties and the jurisdiction rest with the RDO, Salem.

3.This Court therefore, suo moto impleads the RDO, Salem as third respondent.

4.Mr.E.Balamurugan, learned Special Government Pleader takes notice for the third respondent.

5.The learned Special Government Pleader made a statement on instructions that a preliminary enquiry will be conducted by the second respondent on 23.04.2021 at 4.30 p.m. at the office of the second respondent.

6.The second respondent is now required to make his preliminary enquiry, after issuing notice to all the parties who are likely to be affected by his decision, grant them a fair and effective hearing and submit his report within a period of eight weeks from 23.04.2021 and to make over the same to the third respondent, who in turn will hold his enquiry and dispose of the matter in the same manner within a period of 12 weeks thereafter.
