O R D E R
This Writ Petition has been filed seeking for issuance of Writ of Mandamus directing the respondent to consider the petitioner's representation dated 03.04.2018 wherein the petitioner has requested to grant permission to take out procession and to garland the statute of Dr.Ambedkar situated at Suriyakulathu Medu, Arni Town, Thiruvannamalai District and as a part of this programme, the petitioner has also sought for permission to conduct cultural events on 14.04.2018. 2.The learned counsel appearing for the petitioner has submitted that the petitioner is a resident of Ambedkar Nagar, Arni Town and that all the residents in the said locality have decided to celebrate the birth and death anniversaries of great leaders, who sacrificed their lives for our nation. In order to remember the high thoughts, hard work and dedication of the leaders for the development of this country, they have planned to celebrate the birth anniversary of Dr.Ambedkar on 14.04.2018. In this regard, the petitioner has also given a representation on 03.04.2018 to the respondent seeking permission to take out
procession and garland the statue of Dr.Ambedkar situated at Suriyakulathu Medu, Arni Town, Thiruvannamalai District and also to conduct cultural events on the same day. Since the respondent has not passed any order on the representation of the petitioner, the petitioner has approached this Court by filing this Writ Petition.
3.Mr.D.Suriyanarayanan, learned Additional Government Pleader appearing for the respondent submitted that the respondent has no objection for the petitioner to garland the statue of Dr.Ambedkar situated at Suriyakulathu Medu, Arni Town, Thiruvannamalai District on 14.04.2018. But their request to take out procession cannot be considered for the reason that it would create law and order problem in the vicinity. However, on 12.04.2018, the Sub Inspector of Police, Arni Town Police Station has granted permission to the petitioner to conduct cultural events in the evening at about 09.00 pm on 14.04.2018 in Ambedkar Nagar, Arni Town.
4.The learned counsel appearing for the petitioner has submitted that since the Sub Inspector of Police, Arni Town Police Station has granted permission to conduct the cultural events, the organizers of the function would take special and adequate care not to create any inconvenience to anyone, either at the time of garlanding the statue of Dr.Ambedkar or at the time of conducting the cultural events at 09.00 pm on 14.04.2018. 5.Recording the undertaking given by the learned counsel for the petitioner and also the limited permission granted by the Sub Inspector of Police, Arni Town Police Station, the Writ Petition is disposed of. It is also made clear that the petitioner is not entitled to take out any procession causing public nuisance to others in their area.
