It is reported that the sole appellant in the appeal died.

2. C.M.P.Nos.4168, 4171 and 4173 of 2024 have been filed to condone the delay of 1002 days in filing the petition to set aside the abatement caused due to the death of the sole appellant, to bring the legal heirs of the deceased sole appellant 1 to 4 by ranking them as 2 to 5 in the appeal and to set aside the abatement caused due to the death of sole appellant.

3. Heard the learned counsel for the petitioner/appellant and the learned counsel for the second respondent and has no serious objection to allow these petitions.

4. Perused the affidavit in support of the petitions and satisfied with the reasons stated therein. Accordingly, these CMPs are ordered as prayed for and delay is condoned.

6. Registry is directed to carry out the necessary amendment.

7. Post the matter after three weeks.
