ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents 2 to 5 to re- fix the pay fixation of the Petitioner's representation dated 25.04.2025 as per the revised pensions scheme within the stipulated period of time.

2. With the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.

3. The learned counsel appearing for the petitioner would submit that the petitioner worked as Superintendent in Government Primary Health Centre and retired on 31.10.2004 and he worked as Government Servant for 34 years in different capacity. He entered service in the year 17.08.1971 however, it is

claimed that while he was in employment, the pay scale which was fixed in the year 1996 is incorrect and the petitioner is entitled to pay fixation at higher rate. It is submitted that immediately after the retirement, the petitioner repeatedly made a representation for re-fixation of pay and revise the pension however, the same was not considered. Hence, the present writ petition is filed.

4. The learned counsel for the petitioner would submit that this Court may issue a direction to the respondent to consider the petitioner's representation dated 25.04.2025 and pass appropriate orders within a specified time.

5. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

6. The fact of the present case is not in dispute. Admittedly, the petitioner entered service in the year 1971 and he retired from service in the year 2004. He claims that initial scale of pay was not fixed properly and he is entitled for higher pay in the year 1996 however, after 8 years, he retired from service in the year 2004. Thereafter, after a lapse of 21 years, the petitioner made a representation on 25.04.2025 for re-fixation of pay which was fixed in the year 1996. Such a long delay has not been explained properly.

7. Accordingly, this Writ Petition is dismissed on the ground of delay and laches. No costs.
